Does this mean that all flavored vapes are illegal?

No. This is the nuance that makes this issue so confusing and problematic. The answer as of 6/2/2026 is:

  • Not all flavored vapes are federally illagal.

  • Not all flavored vapes are federally authorized.

  • A product can be federally authorized and still be illegal for sale in a particular state or city.

  • A product can be federally unauthorized yet still be on the market because of pending FDA review or enforcement discretion.

What products are currently authorized?

As of today, June 2, 2026, and based on the most recent information from the FDA, the list is surprisingly small and is dominated by the following brands:

  • Vuse

  • NJOY

  • Logic

  • JUUL (certain products)

  • Recently authorized Glas pods

What is the big change in this new 2026 guidance?

Historically, the FDA authorizations were almost entirely Tobacco flavor or Menthol flavor. In May 2026, the FDA authorized two non-tobacco, non-menthol flavors: Glas Gold (mango), and Glas Sapphire (blueberry).

What popular brands are NOT authorized per the FDA?

Any brand or product not expressly on the authorized list, is unauthorized. Popular examples include:

  • Geek Bar

  • Elf Bar / EBCreate

  • Lost Mary

  • Breeze

  • Raz

  • Hyde

  • Fume

How are so many stores still selling these unauthorized products?

Many of those products are technically being sold in violation of FDA marketing requirements, but FDA enforcement is selective, resource-constrained, and has historically focused on manufacturers, importers, distributors, and large-volume targets rather than every individual vape shop.

FDA Authorization does not mean Immediate Market Removal

The FDA does not have an army of inspectors canvassing every vape shop. Instead they use warning letters, import seizures, customs actions, injunctions, and civil money penalties.

Imported Disposable Vapes

Most of the products dominating vape stores today are imported disposable vapes like Raz, Geek Bar, Lost Mary, Fume, Flum, Breeze, etc. Many entered the market during periods when FDA review processes were backlogged, enforcement was inconsistent and demand was enormous.

Why the heightened scrutiny NOW?

While the FDA’s stance on these products has changed very little, the card brands (mainly Visa as the chief watchdog of card brand compliance) is now accelerating scrutiny of merchants in this category. They are lending the FDA their near infinite fining authority to aid in enforcement.
